We regularly review and update the content of this Notice to make sure it reflects as closely and transparently as possible what we do with your data. Our latest updates include:

INTRODUCTION

This Privacy Notice is directed at any individual (hereafter “you”) interacting with Bruker on a regular or an ad hoc basis, either as

  • Customers and/ or contacts within our customers,
  • Online visitors and users of Bruker online services,
  • Onsite visitors,
  • Suppliers, business partners and/or distributors.

This Privacy Notice explains who we are, how we collect, share, and use personal information and how you can exercise your privacy rights.

ABOUT THIS POLICY

This Privacy Notice applies whenever:

  • You visit a Bruker website, use our Bruker platforms, applications and other online services or products under our control (altogether refer to as “Online Services”),
  • You create a user account on Bruker.com, to get access to:

    - Specific and/or confidential information,
    - Certain Bruker Application Communities,
    - Services from the Bruker web shop (or Bruker store), etc.

  • You share your contact information, personal and/or business, with Bruker for the purpose of:

    - Filling out a contact form to enquire about our products and services,
    - Registering and/or participating to an event online or in person (tradeshows, conferences, online training, webinar),
    - Checking-in at the reception of one of our sites in preparation to your visit,
    - Responding to a survey.

  • You enter a contractual relationship, either directly or on behalf of your employer, with Bruker, as a customer, distributor, supplier, business partner, etc.

  • We personalize your experience based on our past interactions with you,

Please note in some cases, specific privacy notices will apply instead of this Privacy Notice or complement it.  In such cases you will be informed about which privacy notice will apply.

For example:

  • The processing of personal data of Bruker employees, or former employees, members of staff, contractors, or any other individual working on Bruker sites, whenever it relates to recruitment and employment purposes, is subject to Bruker Staff Privacy Notice. Conversely, any interaction a member of Bruker Staff has with our Online Services, such as subscription to our newsletter, the creation of a Bruker account, a purchase from Bruker store, etc., is subject to this Privacy Notice,
  • The processing of personal data of job applicants is subject to Bruker candidate privacy notice
  • The processing of personal data of visitors to one of our Bruker sites or campuses will be integrated by a local visitors’ privacy notice,

DATA CONTROLLER

The Bruker company responsible for the collection and use of your personal data (the so called “Data Controller”), who decides what data to collect, how to use it, for how long to store it, and with whom to share it, depends on your relationship with us.

The Data Controllers can be:

        i.          Bruker Corporation, 40 Manning Road, Billerica, MA 01821, USA, whenever you visit the Bruker.com website,

      ii.          The Bruker Company and, where applicable, its joint controller affiliated companies in charge of managing the relationship with you, whether you purchase a product, visit a product line specific website other than Bruker.com, create a user account on a Bruker website, fill out a contact form, provide services to us, visit our campuses, etc.

LEGAL GROUNDS TO PROCESS YOUR DATA

We rely on various legal basis, as described below, to process your personal information, including:

  1. The performance of a contract between you and us, such as the completion of a purchase order,
  2. Our duty to comply with the law or with a specific legal obligation, for example when we need to collect certain information for invoicing and auditing purposes,
  3. Our legitimate interest, to the extent it is not overriding your interests, rights and freedoms, for example where we use your contact information to communicate with you as a representative of your employer, which is our customer,
  4. Your clear and specific consent, for instance before proceeding to a recording of a webinar or sending you commercial material, or to participate in scientific research activities in clinical trials.

We will use the personal information we collect from you only for the purposes described in this Privacy Notice or for specific purposes that we explain to you at the time we collect your personal information.

As a general principle, your provision of any personal information to Bruker is entirely voluntary; there are generally no detrimental effects on you if you choose not to do so. However, there are circumstances in which we cannot act without certain personal data, for example because this personal data is required to process your orders or requests, manage the contractual relationship Bruker maintains with you or the company you work for, or provide you with access to a specific online content or newsletter. In these cases, if you do not provide the necessary personal data, we will not be able to provide you with what you request.

  • To any competent law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person,
  • To an actual or potential buyer (and its agents and advisers) in connection with any actual or proposed purchase, merger or acquisition of any part of our business, provided that we inform the buyer it must use your personal information only for the purposes disclosed in this Privacy Notice,
  • To any other person, after obtaining your informed consent to the disclosure.
MEETING RECORDING

Upon prior information and subject to your consent only, Bruker may record business meetings, calls, trainings (herein referred to as “Meeting(s)”) whether they take place via a video conferencing tool (such as Microsoft Teams), or in person/hybrid among (i) Bruker employees, contractors, consultants, temporary and other workers, including all personnel affiliated with third parties, (ii) customers, or (iii) any business partners, distributors, or suppliers.

The recording of a meeting will mainly serve for:

  • Future reference or preserving the organization's knowledge on a specific topic discussed during the Meeting,
  • Participants who cannot attend the live Meeting and wish to listen or relisten to it at a more appropriate time, or
  • Training purposes.

When you join an online or voice call, we will have access to your name, last name and, where relevant, your email address. Your name and last name will be always visible during an online Meeting.

Each participant to a Meeting can express their consent to be recorded either by turning their camera on, and/or turning their microphone on, and/or sharing their screen. By doing so, we will then capture your picture, and/or your voice, and/or the content of the shared screen, in addition to the list of who spoke and when.

We will store the recording file and the related transcripts, if activated, for the retention time required to accomplish the meeting or recording purpose. You can ask additional information on the storage time to the Meeting organizer. If you are a Bruker employee, or a third party who has signed a confidentiality agreement with Us, you can ask a copy of the file directly to the Meeting organizer.

Customer service-related conversations, employee-related matters, one-on-one meetings, Q&A sessions, informal discussions and any type of meetings that entail confidential, legal or compliance consideration shall be excluded from Meeting recordings.

COOKIES AND OTHER TRACKING TECHNOLOGIES

We use cookies and other tracking technologies on our website. Some are essential to operate our website (Strictly Necessary Cookies) and are always active. We also use, on a prior consent based, cookies to analyze the traffic on our website and improve its performance (Performance Cookies), to provide you with enhanced functionality and personalization (Functional Cookies), and to build a profile of your interests and show you relevant ads (Targeting and Advertising Cookies). SOCIAL MEDIA

When you visit our social media pages, it may be necessary to process data relating to you.

Besides us, the respective providers of the social media platform are also responsible for processing your personal data. As far as we can influence this and parameterise the data processing, we will work within the scope of the possibilities available to us, to ensure that the provider of the social media platform handles your data in a manner that complies with data protection regulations. The data you enter on our social media pages, such as usernames, comments, videos, pictures, likes, public messages, etc., are published by the social media platform and are at no time processed by us for other purposes. We only reserve the right to delete content if necessary. We may share your content on our website if this is a feature of the social media platform and communicate with you through the social media platform if necessary, based on the legitimate interest of carrying out public relations and communication.

We also occasionally use the social media platforms described above to deliver targeted advertising based on your consent.

We also use information about visits or interaction with other sites (so-called remarketing) to define target groups. For this purpose, we also use, inter alia, cookies. In these cases, we obtain the consent of the users on other pages in advance through a consent banner.

The provider of the social media platform may use web tracking methods, which can sometimes be performed regardless of whether you are logged in or registered with the social media platform. In this respect, we have no influence on the processing of your data by the provider of the social media platform, so that the use of the social media platform is at your own responsibility. INTERNATIONAL DATA TRANSFERS

Bruker operates within a global network of companies and partners, therefore your personal information may be transferred to and processed in countries other than the country in which you reside, including the European Union, Switzerland, Singapore, the UK, and the United States. Transfers of personal data outside of your country of origin are made according to the applicable data protection laws, based on the implementation of appropriate safeguards such as:

  • A decision taken by the competent data protection authority declaring that the level of data protection of the country of destination is adequate; or, in the absence of such decision,
  • Standard Contractual Clauses, depending on the data protection law applicable to you, or
  • Where applicable, your consent.
RETENTION OF YOUR PERSONAL INFORMATION

We retain personal information for as long as needed or permitted to fulfill the purpose(s) for which it was collected or obtained, as described in this privacy notice. The criteria used to determine our retention periods include: (i) the length of our relationship with you; (ii) whether there is a legal obligation to which we are subject that affects the personal information (e.g., statutory retention times applicable in the jurisdiction where you are located); (iii) whether retention is determined to be necessary or advisable for Bruker due to applicable statutes of litigation, or other legal or regulatory obligations.

SECURITY OF YOUR PERSONAL INFORMATION

We use appropriate technical and organizational measures to protect the personal information that we collect and process about you (i) from accidental or unlawful destruction, and (ii) unauthorized loss, alteration, disclosure of, or access to Personal Data. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information. We require the same level of diligence from any third party involved in the processing of your personal information in accordance with applicable laws.

Our websites, products and services may contain links to other websites, applications, products, or services that are not owned or operated by Bruker, such as social media websites and applications like Facebook, LinkedIn, Xing, and X. You should carefully review the privacy policies and practices of other websites, products, and services as we cannot control and are not responsible for privacy policies, notices, or practices of third-party websites, applications, products, and services.

DATA PROTECTION RIGHTS

General information

Please note that in many circumstances, we cannot effectively do business with you without processing some personal data about you (e.g., your contact information when you submit a product enquiry). If you are unable to provide this information, we may be unable to process your request.

To the extent that the Country or State in which you are located when you provide us with your personal data has a data protection law that requires us to offer some or all of the following rights to you, we will provide the following rights to you based on the applicable law:

  • To request access to and a copy of your personal data, including to provide your personal data directly to another organization, i.e., a right to data portability,

You are entitled to lodge a complaint with the supervisory authority responsible if you believe we do not comply with the applicable data protection law.

 You can exercise your privacy rights with Bruker at any time either by filing a request on our dedicated platform or sending an email to privacy@bruker.com .

If you are located in California

If you are a California resident, California law provides you with the following rights with respect to your personal information:

When you exercise these rights and submit a request to us, we will verify your identity by asking you for your email address, telephone number, information about your company’s contract or your direct relationship with Bruker. We also may use a third-party verification provider to verify your identity.

Your exercise of these rights will have no adverse effect on the price and quality of our goods or services.
For the 12-months period prior to the date of this Privacy Notice, Bruker has not sold any personal information, nor does it have any plans to do so in the future.

We may update this Privacy Notice from time to time in response to changing legal, technical or business developments. When we update our Privacy Notice, we will take appropriate measures to inform you, consistent with the significance of the changes we make.
